Willful Violations

Willfulness under OSHA is a complex concept. OSHA does not always get it right!

  • Did you knowingly and purposefully violate a regulation that you knew applied to your work?
  • Did you act with reckless disregard for the safety of your employees?

    If you answered “No” to the above two questions, you may not be liable for a Willful violation even if OSHA says you are. If you have made a good faith effort to comply with OSHA’s requirements you may be able to avoid Willful charges.
